A Man Who Represents Himself Has A Fool For A Lawyer

A man in Bowling Green, KY showed again why it is never a good idea to walk into court without a lawyer. Mick Sherrell believes that a city smoking ban is infringing on his rights.

Bowling Green attorney Mark Alcott, who represents the city, filed a response Thursday to Sherrell’s complaint, stating that Sherrell had not met procedural requirements set forth in Kentucky civil cases to seek an injunction.

Yes! Sherrell was the little guy in the room and he had no idea what he was doing. This is why criminals fire their lawyer and start submitting their arguments written in crayon. The defendant knows his goose cooked; the goal thereafter is to put on a three-ring circus in front of the judge.

Sherrell maintained that the ban prevented him from being able to make decisions about his business regarding smoking.

“I understand completely the city wanted to look out for the health of the public at large, but the public at large has the choice to go to my business or not,” Sherrell said. “I’m not the place you must go (for auto service).”

“My liberties are being impinged!” is a political argument not a legal one and I’ll prove it later.

“I knew that the city was going to try to beat me down with procedure, because I know that’s the weakest part of my case,” Sherrell said. [...]

“I’ve had a thousand people ask me why I haven’t hired an attorney, and it’s pretty obvious I cannot afford an attorney, and I don’t spend money I don’t have,” Sherrell said.

I guess it was worth paying the court fees just to say that he did it. David at least had a plan for success when he walked onto the battlefield against Goliath. A better way to stop bad laws is to elect conservative representatives and show up in force when these proposals come up for a vote.

Opponents of the ban agued [sic] that government should respect individual liberties and business freedoms. Ban opponents made up a strong majority of the approximately 140 people who sat and stood to participate in the proceedings – plus at least a dozen more who watched on television from the lobby of the county’s Newport administrative building.

That is how it’s done successfully. No lawyers required.

Put this in the Dog-Bites-Man category of desperate news reporting. WKDZ is reporting that a 2.4 magnitude earthquake occurred near Paducah on March 24th. The earthquake was felt by no one and no damage was caused by this non-quake earthquake. Somebody tell me where is the story on this?

During the last week there were 38 earthquakes in this region surrounding the Madrid fault that no one cared about. Where is the love for them if that one in Paducah was so important?

Give it away for free!

My car came pre-installed with an XM satellite radio. Every few months I get new offers/pleas to re-activate my radio. Sirius-XM offers two weeks free. They also offer 5 months of service for $20. $20 is a great deal for someone who will use the service a lot more than I do. Beyond just my disinterest in subscribing, I wonder if Sirius-XM will still be operating in the long-term.

Offering a free trial is a good way to gain more business but I think Sirius-XM has made this offer so often that it doesn’t gain them anything. I listened to XM last year when they gave it away during the Christmas season.  I enjoyed it while the free trial was there but I still didn’t care to subscribe. During the third quarter of this year the service added 334,000 subscribers. Though these subscribers likely aren’t worth much since they probably came in via deeply discounted offers like the one I have.

I don’t know if satellite radio is going to work in the long-term but it is silly to give away free service so often.

Early this morning, an elderly woman drove her Nissan Murano through the front door of the Hopkinsville Post Office. Neither the driver or USPS employees were seriously injured. This incident raises several questions. Why is it so common for people to crash their cars into buildings while they are maneuvering in a parking lot? Elderly drivers often have this problem but it is not exclusive to the elderly.

Another question I have is why did the people on-scene turn the vehicle around inside the building and drive it out the same way it came in? Wouldn’t you expect they’d put the car in neutral and pull it out backwards with a winch? Finally, we should give credit to the Nissan Motor company for building such a sturdy vehicle. The Murano was completely undamaged except for a dent in the bumper on the left side and the black molding under the bumper was broken.

I took these when I left work the same afternoon. There was already a construction guy there planning how to make repairs.

Suffer the Consequences of Political Correctness

In April of this year the Transportation Director for Christian County Public Schools was terminated due to allegations of sexual harrassment. The Board of Education did not even have the courage to say publicly why Elzie Pollard was being canned.

HUNEYCUTT SAID SHE COULD NOT COMMENT ON WHY POLLARD WAS PLACED ON LEAVE OR WHEN HE MIGHT RETURN TO WORK. SHE SAYS IN THE MEANTIME, OFFICIALS ARE WORKING TO FIND SOMEONE TO FILL HIS POSITION.

Roger Kerns was eventually picked as the new Transportation Director. Mr. Kerns redrew the bus routes for the entire county during the two month summer break. It is little wonder that the necessary paperwork was not delivered to the schools on time.

SEVERAL STUDENTS WERE NOT PICKED UP AT ALL YESTERDAY (TUESDAY), WHILE OTHERS DIDN’T ARRIVE AT SCHOOL UNTIL AROUND 11 O’CLOCK AND THEN STUDENTS AT CHRISTIAN COUNTY HIGH SCHOOL WEREN’T ALLOWED TO LEAVE UNTIL AROUND 5 O’CLOCK.
THE ISSUES STEM FROM A CHANGE IN BUS DRIVERS, BUS ROUTES AND NOT HAVING PROPER PAPERWORK AT THE SCHOOLS.
The result of the new, undocumented bus routes is a giant clusterfark that put lives at risk.
WATER WAS PROVIDED TO STUDENTS ON BUSES, A PRECAUTION LINK SAYS WAS TAKEN DUE TO THE EXCESSIVE HEAT, BUT ONE STUDENT WAS TAKEN BY HER PARENTS TO THE HOSPITAL AND WAS TREATED FOR DEHYDRATION.
Mr. Kerns and Superintendent Link are both responsible for how this situation was handled. It is my opinion that the ultimate cause is the fact that fear of lawsuits rule the day. Elzie Pollard was abruptly removed from his position based on the accusation of misconduct without an orderly transfer of responsibility.

God help all of the bus drivers this year. They will get no help from anyone else.

Teenagers hold-up Dollar Store

Three female teenagers walked into a Dollar Store in Ohio and tried to rob it. They were refused when store employees said they couldn’t get into the safe. The teenagers left empty handed and were arrested about a mile away.

When a manager claimed that she could not open the store safe, the alleged robbers–Jocelyn Addison, 19; Nia McBrayer, 21; and Jenniffer Watson, 18–departed empty-handed. Though the downloaded list was clearly written tongue-in-cheek, the suspects, who had masks, a plan, and a bb gun, apparently followed some of its suggestions.

You can read the instructions they used at listentome.net. I’m of the opinion when teenagers do stupid stunts like this they should spend a night in real prison, share space with other prisoners. I wouldn’t let it go so far as let the kids get hurt while their inside the prison but I think they ought to have a personal experience.

Hardware is Fragile

I’m gonna give up on working with computer hardware. Certainly there are more ways to destroy a circuit board than there are grains of sand in the ocean. After buying my brand new Shuttle PC; I had the bright idea that I was going to install a second hard drive. After several minutes working on the machine with the case off I realized some metal shavings might have fallen on to the motherboard below. I turned the machine upside down to try and shakeout anything that might have fallen. I even retrieved my trusty can of compressed air to again blow out any foreign matter. I never did get that hard drive installed.

The next day I was rewarded when I booted the computer and the graphical grub splash screen failed to load. When I hit enter the computer booted normally except that the text was garbled for several seconds during the early stage of booting. With great sadness, I thought for sure I had shortted out the video permanently.

Wait one moment though! Most recently tonight, I again booted the computer and now the grub splash screen loads correctly. What a relief! I hope strongly that I didn’t do any permanent damage. I should know after working for a short time at the Computer Shop that I am no good at hardware at all.
